Middle and Last Names Were Interchanged

What if you found out that your last and middle names were interchanged so that you are actually carrying your mother’s maiden last name as your last name?  How do you correct these kinds of errors in your NSO Birth Certificate (now PSA Birth Certificate)?

This error is considered an error in encoding and can be rectified by filing a petition for correction of clerical error.  Here’s what you need to do:

Prepare the following documents:

  1. Certified machine copy of the birth record containing the entry to be corrected;
  2. Not less than two (2) private or public documents upon which the correction shall be based like Baptismal Certificate, Voter’s Affidavit, Employment Records, GSIS/SSS records, medical records, business records, driver’s license, insurances, land titles, certificate of land transfer, bank passbook, NBI / Police Clearance, civil registry records of ascendants;
  3. Notice / Certificate of Posting;
  4. Prepare payment of P1,000 as filing fee.  If the petition is filed abroad, filing fee is USD 50.00 or equivalent value in local currency.
  5. Other documents may be required by the civil registrar.

The following may file the petition:

  • Owner of the record
  • Owner’s spouse
  • Children
  • Parents
  • Siblings
  • Grandparents
  • Guardian
  • Other person duly authorized by law or by the owner of the document sought to be corrected;
  • If owner of the record is a minor or physically or mentally incapacitated, petition may be filed by his spouse, or any of his children, parents, siblings, grandparents, guardians, or persons duly authorized by law.

The petition must be filed at the Local Civil Registry (LCR) office of the city or municipality where the birth was registered.  If the petitioner has moved to a place that is far from the place of birth, the petition may be filed at the LCR of his current location.  If the owner was born abroad, the petition must be filed with the Philippine Consulate where the birth was reported.

  1. Mam ask ko lang po kng matutulungan ninyo ako sa psa kc po Yun po kasing psa ko apelido po ng nanay ko nasa surname ko…pwde ko po kayang gamitin yung apelido ng tatay ko sa anak ko?tnx in advance po

      1. Nag file po ba kayo ng Legitimation by Subsequent Marriage? Ito ang proseso ng pag legalize ng pag gamit mo ng apelido ng father mo after silang magpakasal ng mother mo. Kung yes, I would also assume na ginagamit mo na ang apelido ng father mo ever since he married your mom. If this is the case, pwede mo na ngang ipagamit sa anak mo ang apelido mo from your father.

    2. Para hindi na po magka problema ang birth certificate ng anak ninyo, kung ano na lang ang apelido niyo na nakalagay sa birth certificate niyo, yun na rin ang apelido na ipagamit niyo sa anak niyo. Pag magkaiba kayo ng apelido, baka ma question ang paternity mo sa iyong anak.

  2. Good pm..tanong ko lang po sana , bat po magkaiba yung date of birth ng asawa ko sa cenomar nya. Yung sa marriage certificate po namin at sa birth certificate nya, yung date of birth nya is august 17,1990. Pero nung kumuha na po ako nung cenomar yung nakalagay dun is august 17,1988.. May mali po ba yun?may dapat po bang ayusin or sadyang mali lang yung type? Lahat ng details tama naman po kaya lang yung year lang ng kapanganakan nya iba.. Thanks po sa sagot in advance

    1. Kung ano po kasi ang nilagay mong information sa request form, yun ang lalabas sa CENOMAR. Hindi po yung birth certificate ang pagbabasehan for CENOMAR kundi ang marriage archive. So posible na mali ang nailagay na date when you requested for his CENOMAR. This should not be a problem naman po especially since may marriage certificate na and tama naman ang birthday na lumabas sa birth certificate.

  3. MY NSO IS CORRECT. REAL SURNAME MIDDLE NAME AND PARENTS

    MY PSA IS NOT CORRECT. WRONG MIDDLE NAME AND PARENTS!!

    THEY SAID THAT I WILL PAY 30k AND WAIT FOR ALMOST 1year to 3years?

    1. Would it be possible that you were registered twice at the LCR?

      Please ask your parents how many times they submitted a registration for your birth.

      It is possible that the FIRST registration they did for you, your middle name and parents’ names were incorrect — and instead of going through the process of CORRECTING the errors, they submitted a NEW REGISTRATION for you instead, this time with the correct information.

      Now, you may have been given the CORRECT copy of your birth certificate before — as a result of the second registration done under your name. HOWEVER, when PSA fixed their records, they found out that you are one of the many Filipinos who have DOUBLE REGISTERED birth details.

      What the PSA did for these types of cases is to disregard the SECOND REGISTRATION and honored the FIRST REGISTRATION (which is the right thing to do because that is the original record to begin with).

      YOu are now getting the erroneous copy of your birth certificate because the second registration has been disregarded by the PSA’s system.

      If there are errors in your birth certificate, proceed to the LCR (municipal hall or city hall) of your birthplace and ask for their advise on how to best apply the needed corrections on your document.

      Some errors may require the services of a lawyer and undergo court hearing, so please be guided.

  4. Pano po ba ang gagawin at kaylan ko para maayos ang birthcerticate ko.
    Sa PSA Ang name ko Maricris Sicad Maraño full name ko dahil ginamit na apelyedo middle name ng father ko..
    Ang gamit ko po sa lahat ng record ko Maricris Sicad Quintino at ito po ang tama..
    Naikasal po ako na ang gamit ko ay yang tama kong full name..
    Nais ko bumalik ng abroad pero hindi ko maiayos pano po ba gagawin ko..

    1. Papano po kayong naikasal na hindi yung apelido niyo sa birth certificate niyo ang nakalagay sa marriage certificate ninyo?

      Kung ang gusto niyo po ay palitan yung apelido niyo sa birth certificate, kailangan:

      1. Ma-acknowledge kayo ng father niyo through an AUSF (authority to use surname of father), o kaya ay

      2. Makasal ang parents mo at mag undergo ka ng Legitimation Due To Subsequent Marriage

      3. O kaya ay ampunin ka legally ng father mo.

      4. O padaanin mo sa court ang proseso para sa change of last name.

  5. Bakit yon kapatid ko po kulang ng name Gerardo lang which ang dapat Mario Gerardo Ang pag correct sabi sa Munisipyo ng Cabanatuan P7,700 ang magastos. Yon expenses po ba Universal ang halaga?

    1. Hindi po pare-pareho ang rates ng mga munisipyo dahil sa tax mapping. Basta’t siguraduhin niyo po na empleyado ng munisipyo ang kausap ninyo at lahat ng babayaran niyo ay ma-issue-han ng resibo ng gobyerno para makasiguro kayong hindi fixer ang kausap ninyo.

  6. yung lastname at middlename ko po nagpalit Michelle barangan Besana po sa birth ko instead of Michelle Besana Barangan, kasi nung time na yun di pa kasal si mama at papa pero may certification po na ni.request si papa na tama na po yung complete name ko after kasal nila. panu po ba ito?

      Kung hindi sila kasal nung ipinanganak ka, bakit baliktad ang middle at last names mo? Dapat sana, wala ka lang middle name, ung last name ng mother mo ang ilalagay as last name mo.

      Itanong niyo sa munisipyo kung legitimation due to subsequent marriage ang kailangan mo (bilang hindi kasal ang parents mo nung ipinanganak ka) o baka kailangang dumaan sa korte ang case mo since change of last name ang mangyayari.

  7. Gudpm po.. Ano b dapat gawin para ma correct po yung birthdate ng father ko, november 21, 1969.. Pero nsa Local birth certificate po nya november 21, 1965..

      Nag try na ba kayong mag inquire sa LCR kung saan siya naka rehistro kung may copy sila ng birth certificate ng father niyo na malinaw or tama ang nakasulat na details?

      Kadalasan meron silang correct copy. Pwede niyo itong ipa-endorse sa PSA (dating NSO) para makakuha kayo ng correct NSO copy ng birth certificate niya. Kung wala, kailangan ninyong ipa-correct ang birth year niya at kakailanganin ninyo ang services ng isang abogado para dito.

    Ako po si Jerby Hortelano Tejeno,kaya po ako nagkalakas nang loob na magcomment dahil po may problema sa apelyedo ko.Instead of Jerby Hortelano Tejeno po sa NSO ko po ay Jerby Tejeno Hortelano.Naibigay ko na po yong lahat nang hiningi po at naipaprocess ko na po noong August 2016 at ang sabi po with in 3 months matatangap ko na po yong NSO ko without a problem na but ang tanong ko po bakit hanggang ngayon hindi ko pa po na receive NSO ko?Ilang taon ba natin dapat iprocesso ito?Kailangan ko na po kasi yong NSO ko..Yong gamit na ang apelyedo ko na Jerby Hortelano Tejeno..thanks

      1. Good eves po,pinafollow up ko na po but ang laging sabi wala pa raw…maitanong kulang po ilang buwan o taon po ba yang iprocess…kasi po sabi 3 buwan matatanggap ko na po yong right na NSO ko po..

      2. May importante po kasi akong pagagamitan nito…matagal na po ding hiningi nang company ko yong NSO ko po…paano ko po ibibigay sa kanila kung hanggang ngayon wala pa.thanks po

Good day po ,,may problema po ako sa date of birth po, sa municipio po tama po yun date of birth nakapg abroad na po ako ng ilang taon , nun umuwe ako kumuha ng nso ang lumalabas po ay mali po yun date of birth ko.. Ano po bang dapat gawin po malaki po ba ang magagastos sa pag papa correct ng date of birth ..maraming salamat po..

Yung naka input po sa birthcertificate ko middle initial lang ng mother ko nagpunta kami sa munisipyo namin para ipaayos iyon kaso hinihingian pa kami ng birthcertificate ng nanay ko at birthcertificate pati ng mga kapatid ko kaso middle initial lang din ang meron sa mga kapatid ko pano po kaya yun?i need your reply po Kung kailangan talaga pati birthcertificate ng mga kapatid kailangan talagang isubmit?

Good day, my son was born 1998, his dad and got married feb.2011..at the local registrar his records show he is under his dad last name..elementary he used his dad lastname..but when was graduating from high school we apply his nso and find out in NSO records he is under my last name…what we will do..my son is in 2nd year college now and we want him to use his father lastname.hope you can help us..thank you
